TERMS AND CONDITIONS OF SALE

These Terms and Conditions apply to purchases made through www.carolinevyzas.com, operated by Caroline Vyzas, an independent artist based in Switzerland.

2. SCOPE

These Terms apply to online sales of artworks and related items offered through this website. By placing an order, you confirm that the information you provide is accurate and that you are legally able to enter into the purchase.

Nothing in these Terms limits any mandatory consumer rights that apply to you under the law of your country of residence.

3. ARTWORKS AND PRODUCT DESCRIPTIONS

We make every reasonable effort to describe and photograph artworks accurately. Colours may appear slightly different depending on screen settings, lighting and device calibration.

Original artworks are handmade and may show natural variations, textures and signs of the artistic process. Certain mixed-media works may begin with a printed base and are then individually transformed, painted, altered or finished by the artist. These variations are part of the artwork and do not constitute defects.

Dimensions are approximate unless expressly stated otherwise.

4. PRICES AND PAYMENT

Prices are shown in the currency displayed on the website or at checkout. Shipping costs, applicable taxes and any other charges collected by us will be shown before the order is completed.

For international orders, import VAT, customs duties, brokerage or handling fees may be charged by the destination country or carrier unless expressly stated at checkout that such charges are included. Please also see our Shipping Policy.

Payments are processed through the payment methods made available by Shopify and its payment partners. Caroline Vyzas

does not receive or store full payment card details.

5. ORDERS AND ACCEPTANCE

After placing an order, you will receive an electronic confirmation. This confirms that the order has been received; it does not prevent us from contacting you if an item is unavailable, a price or description contains an obvious error, or the order cannot reasonably be fulfilled.

If we are unable to accept or fulfil an order, we will inform you and refund any amount already paid for that order.

6. AVAILABILITY

Original and one-of-a-kind artworks are subject to availability. If an artwork has been sold elsewhere or is otherwise unavailable, we will contact you as soon as possible and issue a full refund if payment has already been taken.

7. DELIVERY

Orders are shipped to the delivery address provided at checkout. Estimated preparation and delivery times are provided on the website, product page, Shipping Policy, checkout or order confirmation.

Delivery dates are estimates unless a specific delivery date has been expressly agreed. Where mandatory consumer law requires delivery within a particular period, those rights remain unaffected. If a longer production or delivery period is clearly stated and accepted when you order, that agreed period applies.

Risk of accidental loss or damage during transport remains with the seller until the artwork is received by the customer where required by applicable consumer law, except where the customer independently chooses and contracts a carrier not offered by us.

8. ADDRESS CHANGES

Please check your delivery address carefully before completing your order. If you notice an error, contact us as soon as possible at caroline.vyzas@gmail.com.

We cannot guarantee that an address can be changed once an order has been dispatched. If a parcel is returned because an incorrect or incomplete address was supplied by the customer, reasonable additional shipping costs for re-dispatch may be charged, where permitted by law.

9. RETURNS, WITHDRAWAL AND REFUNDS

Returns, statutory withdrawal rights, damaged or incorrect orders and refunds are governed by our Refund & Return Policy, which forms part of these Terms.

For consumers in the European Union / EEA, a statutory 14-day right of withdrawal may apply to online purchases. Certain exceptions apply, including goods made to the customer's specifications or clearly personalised. Mandatory rights remain unaffected.

10. DAMAGED OR NON-CONFORMING ITEMS

If an artwork arrives damaged, defective, or materially different from what was ordered, please contact us promptly and provide photographs of the artwork and packaging where relevant. We will provide an appropriate remedy in accordance with applicable law.

11. COPYRIGHT AND INTELLECTUAL PROPERTY

Purchasing an artwork transfers ownership of the physical artwork only. Copyright and all other intellectual-property rights in the artwork remain with Caroline Vyzas unless expressly agreed otherwise in writing.

The artwork may not be commercially reproduced, copied, licensed, manufactured, distributed, or used for commercial advertising or merchandise without prior written permission.

Customers may photograph and share images of purchased artworks for normal personal and non-commercial purposes, including on personal social-media accounts, provided that the use does not falsely suggest endorsement or transfer of copyright.

Caroline Vyzas may continue to use images of sold artworks for portfolio, archive, exhibition, publication, website, social-media and promotional purposes, unless otherwise agreed in writing.

12. PRIVACY

Personal information is handled in accordance with our Privacy Policy. We share information only as reasonably necessary to operate the store, process payment, fulfil orders, arrange shipping, comply with legal obligations and provide customer service.

13. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights.

To the extent permitted by law, Caroline Vyzas is not responsible for indirect or consequential losses that were not reasonably foreseeable at the time the contract was made.

14. FORCE MAJEURE AND DELAYS OUTSIDE OUR CONTROL

We are not responsible for delays caused by events reasonably outside our control, such as severe weather, natural disasters, customs delays, transport disruption, strikes, governmental measures or similar events. We will make reasonable efforts to keep you informed and to minimise disruption.

This clause does not remove any mandatory right you may have to cancel or obtain a refund if delivery is not completed within the applicable or agreed period.

15. CHANGES TO THESE TERMS

We may update these Terms from time to time. The version in force at the time you place an order will apply to that order, unless a change is required by law.

16. Governing law

These terms are governed by Swiss law, subject to any mandatory consumer protection rules that apply to customers in their country of residence and cannot legally be excluded by contract.
